Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Fiftify mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. The App is operated by Fiftify Inc. ("we", "us", "our").

2. Description of Service

Fiftify Mobile is a companion application for the Fiftify inventory management platform. The App allows users to view and manage sales orders, track purchase orders, and monitor inventory levels from mobile devices. The App requires an active Fiftify account and communicates with the Fiftify API to provide real-time data access. The App is available on Android and iOS.

3. User Accounts

To use the App, you must have an existing Fiftify account. You log in using your email and password credentials. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

4. Business Data

The App provides access to your business data including orders, purchase orders, inventory, and supplier information. You retain full ownership of all your business data. We process this data solely to provide the service to you. You are responsible for ensuring that your use of the App complies with any agreements you have with your customers, suppliers, and partners.

5. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Interfere with or disrupt the App's servers or networks
  • Share your account credentials with unauthorized users
  • Use automated means to access the App or extract data
  • Attempt to gain unauthorized access to other users' data

6. Third-Party Services

The App integrates with the following third-party services, each governed by their own terms:

  • Fiftify API — backend data and business logic
  • Sentry — error tracking and performance monitoring
  • Expo Push Notifications — optional mobile notifications

7. Service Availability

The App depends on the availability of the Fiftify API and your internet connection. We strive to maintain high availability but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect App availability. We will make reasonable efforts to notify users of planned downtime.

8. Intellectual Property

The App, including its design, code, graphics, and branding, is the intellectual property of Fiftify Inc. You are granted a limited, non-exclusive, non-transferable license to use the App for its intended purpose. This license does not include the right to modify, distribute, or create derivative works based on the App.

9. Data Storage & Deletion

Your business data is stored on Fiftify servers and accessed via the API. Authentication tokens are stored securely on your device. You may request deletion of your account and all associated data at any time by contacting us or through your Fiftify account settings. Upon deletion, your data will be removed from our servers within 30 days.

10. Limitation of Liability

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the App, including but not limited to loss of data, business interruption, or financial losses arising from incorrect or delayed data display.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated Terms.

12. Termination

We may suspend or terminate your access to the App at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. Termination of the App does not automatically terminate your Fiftify web platform account.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

14. Dispute Resolution

Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Delaware, USA. Each party shall bear its own costs. You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.
